Rental Agreement and Policies for 4Drive Morocco

Welcome to 4Drive Morocco. These terms and conditions govern your use of our car rental services in Morocco. By booking a vehicle with us, you agree to comply with and be bound by the following terms. Please read them carefully before making a reservation.

1. Definitions

In these terms and conditions:

  • "4Drive Morocco", "we", "us", or "our" refers to 4Drive Morocco car rental service.
  • "You", "your", or "renter" refers to the person booking and driving the rental vehicle.
  • "Vehicle" refers to the car or other motor vehicle rented from 4Drive Morocco.
  • "Rental Period" means the period from pickup to return of the vehicle as specified in the rental agreement.
  • "Rental Agreement" means the contract between you and 4Drive Morocco for the rental of a vehicle.

2. Booking and Reservation

2.1 How to Book

You can book a vehicle through our website at 4drivemorocco.com, by email, or by phone. All bookings are subject to vehicle availability.

2.2 Confirmation

Once you submit a booking request, we will send you a confirmation email with your reservation details, including pickup location, rental period, vehicle category, and total price. Your booking is confirmed only when you receive this confirmation email.

2.3 Booking Amendments

You may amend your booking by contacting us via email or phone at least 48 hours before your scheduled pickup time. Changes are subject to vehicle availability and may incur additional charges.

2.4 Free Cancellation

We offer free cancellation up to 48 hours before your scheduled pickup time. Cancellations made less than 48 hours before pickup may result in a cancellation fee equivalent to one day's rental.

3. Driver Requirements

3.1 Age Restrictions

The minimum age to rent a vehicle from 4Drive Morocco is 21 years. For SUVs and 4x4 vehicles (such as Dacia Duster and Toyota RAV4), the minimum age is 23 years. Drivers must have held a valid driving licence for at least one year.

3.2 Driving Licence

You must present a valid national driving licence at the time of pickup. An International Driving Permit (IDP) is recommended for non-European licences and may be required for certain licence types. Both the original licence and IDP must be presented.

3.3 Identification

You must present a valid passport or national identity card at pickup. Photocopies or digital copies are not accepted.

3.4 Additional Drivers

Additional drivers may be added to the rental agreement at the time of pickup. Each additional driver must meet the same age and licence requirements and must be present with their documents when added to the agreement. Additional driver fees may apply.

4. Payment Terms

4.1 No Deposit Required

4Drive Morocco does not require a deposit or credit card hold at the time of booking or pickup. This is one of our key differentiators in the Morocco car rental market.

4.2 Payment Methods

We accept payment by debit card (Visa, Mastercard) and cash (Moroccan Dirham or Euro). Credit cards are not required. Full payment is due at the time of vehicle pickup unless otherwise agreed in advance.

4.3 Pricing

All prices are quoted in Euros (EUR) and include full insurance (Collision Damage Waiver and Theft Protection) and unlimited mileage. Prices may vary based on rental duration, vehicle category, season, and pickup location.

4.4 Fuel Policy

Vehicles are provided with a full tank of fuel. You must return the vehicle with a full tank. If the vehicle is returned without a full tank, you will be charged for the missing fuel plus a refueling service fee.

5. Insurance and Coverage

5.1 Full Insurance Included

All rentals from 4Drive Morocco include full insurance coverage: Collision Damage Waiver (CDW) and Theft Protection (TP). This covers damage to the vehicle and theft, subject to the terms of the insurance policy.

5.2 Excess and Liability

In the event of an accident or damage to the vehicle, you may be liable for an excess amount as specified in your rental agreement. This excess varies by vehicle category. You can reduce or eliminate the excess by purchasing additional Super CDW coverage at pickup.

5.3 Exclusions

Insurance does not cover:

  • Damage to tyres, wheels, windscreen, mirrors, undercarriage, or interior unless caused by a covered accident.
  • Damage caused by driving off-road, on unpaved roads not suitable for the vehicle type, or in violation of Moroccan traffic laws.
  • Damage caused by negligence, reckless driving, driving under the influence of alcohol or drugs.
  • Loss of keys, fuel misfill, or towing charges not authorized by 4Drive Morocco.
  • Personal belongings left in or stolen from the vehicle.

5.4 Accident Procedure

In the event of an accident, you must:

  1. Stop immediately and ensure the safety of all parties.
  2. Contact the local police and obtain a police report (required for insurance claims).
  3. Contact 4Drive Morocco immediately to report the incident.
  4. Complete an accident report form and provide all documentation to us.
  5. Not admit liability or make any settlement without our authorization.

6. Vehicle Use and Restrictions

6.1 Permitted Use

The vehicle may only be driven:

  • On public paved roads in Morocco suitable for the vehicle type.
  • By the named driver(s) on the rental agreement.
  • In accordance with Moroccan traffic laws and regulations.

6.2 Prohibited Use

You must not:

  • Drive the vehicle outside Morocco without prior written permission.
  • Use the vehicle for commercial purposes, racing, testing, or driver training.
  • Sublet or lend the vehicle to any other person.
  • Drive the vehicle while under the influence of alcohol, drugs, or medication that impairs driving ability.
  • Transport more passengers than the vehicle is designed and licensed to carry.
  • Transport illegal goods, hazardous materials, or substances with a strong odour.
  • Use the vehicle to tow or push any other vehicle or trailer.
  • Drive on beaches, dry riverbeds (oueds), desert pistes, or mountain tracks unsuitable for the vehicle type without a proper 4x4.

6.3 Off-Road and Desert Driving

Standard cars and sedans (Dacia Sandero, Dacia Logan, Hyundai Accent) are not permitted on unpaved desert pistes, mountain tracks, or off-road terrain. For driving in the Atlas Mountains or Sahara desert on unpaved roads, you must rent a 4x4 vehicle (Dacia Duster, Toyota RAV4). Damage caused by driving a non-4x4 vehicle off-road is not covered by insurance.

6.4 Traffic Regulations

You must comply with all Moroccan traffic laws, including:

  • Driving on the right-hand side of the road.
  • Speed limits: 60 km/h in urban areas, 100 km/h on rural roads, 120 km/h on toll motorways (autoroutes).
  • Wearing seatbelts at all times for all passengers.
  • Using child seats for children under 12 years (available as an extra).
  • Not using a mobile phone while driving unless hands-free.

7. Pickup and Return

7.1 Pickup Locations

Vehicles can be collected from the following locations:

  • Marrakesh Menara Airport (RAK)
  • Casablanca Mohammed V Airport (CMN)
  • Agadir Al Massira Airport (AGA)
  • Fes Saiss Airport (FEZ)
  • Tangier Ibn Battouta Airport (TNG)
  • Essaouira city center (by arrangement)
  • Ouarzazate city center (by arrangement)
  • Hotel or accommodation delivery in major cities (additional fee may apply)

7.2 Pickup Procedure

At pickup, you must:

  1. Present your driving licence, IDP (if required), and passport.
  2. Sign the rental agreement.
  3. Make full payment (unless prepaid).
  4. Inspect the vehicle with our representative and note any existing damage on the condition report.
  5. Receive vehicle keys, documents, and our emergency contact number.

7.3 Late Pickup

If you are delayed and cannot collect the vehicle at the scheduled time, please contact us immediately. We will hold the vehicle for up to 2 hours after the scheduled pickup time. If you do not arrive or contact us within this period, your reservation may be cancelled without refund.

7.4 Return Procedure

You must return the vehicle to the agreed location by the date and time specified in your rental agreement. At return, the vehicle will be inspected for damage, cleanliness, and fuel level. Please allow time for this inspection.

7.5 Late Return

A grace period of 1 hour is allowed for late return without charge. After this period, you will be charged for an additional rental day or part thereof. If you need to extend your rental, contact us in advance to arrange an extension (subject to availability).

7.6 Early Return

No refunds are given for early return of the vehicle. The rental price is based on the agreed rental period.

7.7 One-Way Rentals

One-way rentals (picking up in one city and returning in another) are permitted subject to availability and a one-way fee. Popular routes include Marrakesh to Casablanca, Marrakesh to Agadir, Marrakesh to Fes, and Casablanca to Tangier. Contact us for one-way fees.

8. Vehicle Condition and Maintenance

8.1 Pre-Rental Inspection

Before accepting the vehicle, you must inspect it carefully and report any existing damage, scratches, or defects to our representative. Both parties will sign a condition report documenting the vehicle's condition. This report is your protection against being charged for pre-existing damage.

8.2 Care of the Vehicle

During the rental period, you must:

  • Keep the vehicle clean and in good condition.
  • Check oil, water, and tyre pressure regularly.
  • Park the vehicle in secure locations and lock it when unattended.
  • Not smoke in the vehicle (a cleaning fee will apply if you do).
  • Report any damage or mechanical problems to us immediately.

8.3 Breakdowns and Repairs

In the event of a breakdown or mechanical failure not caused by your misuse, contact us immediately. We will arrange recovery or repair at no cost to you. Do not attempt repairs yourself or arrange repairs without our authorization. Unauthorized repairs will not be reimbursed.

8.4 Replacement Vehicle

If the vehicle becomes unusable due to mechanical failure not caused by your misuse, we will provide a replacement vehicle as soon as possible. We are not liable for any costs or losses arising from vehicle breakdown, including accommodation, travel, or loss of time.

9. Extras and Optional Equipment

9.1 Available Extras

The following extras are available at additional cost:

  • Child seat or booster seat (required by law for children under 12 years)
  • GPS navigation system
  • Additional driver
  • Super CDW (reduced or zero excess)
  • One-way rental fee
  • Hotel delivery (in major cities)

9.2 Requesting Extras

Please request extras at the time of booking or at least 48 hours before pickup to ensure availability. Some extras can be added at pickup subject to availability.

10. Fines and Violations

10.1 Traffic Fines

You are responsible for all fines, penalties, and charges incurred during the rental period, including:

  • Speeding fines
  • Parking fines
  • Toll road charges (Morocco has toll motorways connecting major cities)
  • Red light or traffic signal violations
  • Any other traffic or legal violations

10.2 Processing Fines

If we receive notification of a fine or violation after you return the vehicle, we will contact you and forward the fine to you for payment. If we must pay the fine on your behalf, we will charge you the amount of the fine plus an administrative fee of EUR 25 per fine.

10.3 Toll Roads

Morocco has toll motorways (autoroutes) connecting Casablanca, Rabat, Marrakesh, Tangier, Fes, and Agadir. Tolls are paid at toll booths in cash (Moroccan Dirham or Euro). Keep receipts for your records.

11. Theft and Loss

11.1 Vehicle Theft

In the event of vehicle theft, you must:

  1. Report the theft to the local police immediately and obtain a police report.
  2. Contact 4Drive Morocco immediately.
  3. Provide us with the police report and all vehicle keys and documents (if recovered).

Theft Protection is included in your rental. However, if you have been negligent (e.g., left keys in the vehicle, left the vehicle unlocked), you may be liable for the full value of the vehicle.

11.2 Loss of Keys or Documents

Loss of keys, documents, or equipment is not covered by insurance. You will be charged for replacement costs and any costs incurred in recovering or replacing the vehicle.

12. Privacy and Data Protection

12.1 Personal Data

We collect and process your personal data in accordance with our Privacy Policy. By booking with 4Drive Morocco, you consent to our collection, use, and storage of your personal information for the purpose of providing car rental services.

12.2 Use of Data

We use your data to:

  • Process your booking and provide rental services
  • Communicate with you about your reservation
  • Send you confirmations, invoices, and rental documents
  • Process payments
  • Handle claims, fines, or violations
  • Improve our services and customer experience

12.3 Data Security

We take reasonable measures to protect your personal data from unauthorized access, loss, or misuse. However, no internet transmission is completely secure, and we cannot guarantee absolute security.

12.4 Third Parties

We may share your data with third parties (payment processors, insurance providers, authorities) as necessary to provide services or comply with legal obligations. We do not sell your personal data to third parties for marketing purposes.

13. Liability and Indemnity

13.1 Our Liability

4Drive Morocco is liable for loss or damage caused by our negligence or breach of contract. However, we are not liable for:

  • Any indirect, consequential, or special loss (including loss of profits, business, or opportunity)
  • Delays, breakdowns, or vehicle unavailability beyond our reasonable control
  • Personal injury or death unless caused by our negligence
  • Loss or damage to personal belongings left in the vehicle

13.2 Your Liability

You are liable for:

  • All damage to the vehicle caused by your negligence, misuse, or breach of this agreement
  • All fines, penalties, and charges incurred during the rental period
  • Any loss or damage to third parties caused by your use of the vehicle
  • Full cost of the vehicle if it is stolen due to your negligence

13.3 Indemnity

You agree to indemnify and hold 4Drive Morocco harmless against all claims, costs, expenses, and losses arising from your use of the vehicle or breach of this agreement.

14. Force Majeure

4Drive Morocco is not liable for failure to perform our obligations due to events beyond our reasonable control, including natural disasters, strikes, war, terrorism, civil unrest, government restrictions, or other force majeure events. In such cases, we will attempt to provide alternative arrangements but are not obligated to do so.

15. Changes to Terms

We reserve the right to update or modify these terms and conditions at any time without prior notice. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.

16. Governing Law and Jurisdiction

16.1 Applicable Law

These terms and conditions are governed by and construed in accordance with the laws of Morocco. Any rental agreement you enter into with 4Drive Morocco is subject to Moroccan law.

16.2 Disputes

Any dispute arising from these terms or your rental agreement shall be subject to the exclusive jurisdiction of the courts of Morocco. We will attempt to resolve disputes amicably through negotiation before resorting to legal action.

17. Severability

If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

18. Entire Agreement

These terms and conditions, together with your rental agreement and our Privacy Policy, constitute the entire agreement between you and 4Drive Morocco. They supersede all prior agreements, representations, and understandings, whether written or oral.
